PROPERTY PURCHASE AND SALE · EU RESIDENTS

Buying new-build or off-plan property in Spain

An off-plan purchase requires checks on the developer, the project and advance payments. We guide the legal work from reservation through delivery and completion.

THE STEPS INVOLVED

From initial review
to practical completion.

Developer and planning documents

We examine ownership of the land, the developer’s position and the available authorisations. Plans and advertised specifications should be compared with the binding contractual documents.

Discuss your situation

Advance payments and guarantees

The payment schedule and applicable protection for advance payments need careful review. A commercial assurance should not be mistaken for a properly documented guarantee covering your purchase.

Discuss your situation

Changes and delays

Delivery dates, permitted variations, specifications and the consequences of delay should be addressed in the contract. We follow up material developments and the explanations or documents required from the developer.

Discuss your situation

Delivery and defects

Completion and occupation documents are checked according to the project’s circumstances. A technical inspection can record defects and reservations, allowing practical follow-up without confusing handover with a waiver of rights.

INITIAL DOCUMENTS

A clear starting point
for your case.

You do not need a complete file to get started. After an initial review, we explain which documents are still needed.

  • Reservation, plans and specifications
  • Developer details and permits
  • Payment schedule and guarantees
  • Delivery correspondence

EU RESIDENTS AND SPAIN

For clients resident in the EU

Your country of residence, nationality and family circumstances may point to different legal and tax requirements. We establish the facts and coordinate your Spanish matter with the relevant advisers.

  • Prepare your identity, address and matrimonial or partnership documents from the country concerned. EU residence does not make every foreign document automatically usable in Spain.
  • Arrange evidence of funds and financing early. A cross-border bank transfer does not replace the Spanish bank’s and notary’s source-of-funds checks.
  • Tell us whether you live in Spain or another EU country. Ownership, immigration status and tax residence are separate questions.
  • We provide the Spanish completion and tax documents for your adviser in your country of tax residence.

FREQUENTLY ASKED QUESTIONS

What you may want
to know before acting.

Is the sales brochure enough?

Keep it, but compare it with the contract and annexes. The exact commitments about the finished property should be clear.

Should I arrange a handover inspection?

It is often useful to document defects. The technical review complements the legal work and supports precise requests to the developer.

What if delivery is delayed?

We examine the contractual dates, reasons given and available options before you agree to changes or decide to withhold a payment.

Does EU residence replace the Spanish purchase checks?

No. We still examine the property and the individual documents. Residence, nationality, the source of funds and any authorisation requirements are separate matters.

Will you work with my adviser abroad?

Yes, where appropriate and with your agreement. We coordinate the Spanish documents and steps with your own qualified adviser, who remains responsible for advice and filings in their jurisdiction.
